With regards to the European Safer Internet Programme 2009-2013, DIGITALEUROPE members, as equipment providers and manufacturers are prepared to play their part in the creation of a safer environment for the use of the internet, including safety aspects, privacy and user rights overall and in particular for children and young adults, while at the same time fostering innovation in the mobile world. <title>White Paper on Smart Grids</title>

<description>The implementation of Smart Grids is central to the development of the European Internal Market for Energy. The drive for lower-carbon generation, combined with greatly improved efficiency on the demand side, will empower consumers to select their most innovative suppliers capable to offer outstanding programs for energy efficiency. Member States shall ensure the implementation of SmartGrids, not only to meet the Carbon emissions and renewable targets, but also to meet the energy efficiency target in which customers will participate actively reversing the overall production to supply value chain. To meet the objectives of aligning regulatory requirements with SmartGrids projects implementation by 2020 without barriers, a Smart Grids Task Force has been established in November 2009 to advise the Commission on policy and regulatory directions at European level and to coordinate the first steps towards the implementation of Smart Grids under the provision of the Third Energy Package. DIGITALEUROPE is one of 25 European Associations representing all European Stakeholders that are assumed to play a role in the implementation of SmartGrids. DIGITALEUROPE has decided to participate actively in the SmartGrids Task Force through the participation in the 3 working groups that have been setup, the Steering Committee and the issue of the present position paper representing the position of DIGITALEUROPE members. We believe that Grids cannot become SmartGrids without the paradigm shift to the new era of Energy Information Management. We believe that other manufacturing and Services sectors have been able to modernize themselves and become more consumers oriented when they became -digitalized&amp;#8214; DIGITALEUROPE believes in the equation of -Smart is Digital&amp;#8214;and -Digital is measuring, prediction and monitoring in real time the Energy we want to save and use as a precious resource, not anymore a commodity.</description>

<title>Position on the EU Standardization Reform</title>

<description>The Digital Agenda for Europe is a critical element for the Europe 2020 strategy to tackle the immediate challenge of the current crisis, to regain competitiveness and to put the EU on an upward path of sustainable growth. The ICT technologies needed for the implementation of the Digital Agenda - high-speed internet, the World Wide Web and related digital technologies for the household and the workplace - are thus essential tools for economic recovery. ICT domain is a fast developing, highly innovative, highly competitive, global market. The standards needed for their implementation are mainly based on global standards developed by fora and consortia. Consequently effective recognition of relevant ICT fora and consortia standards for direct referencing is critical for the global competitiveness of EU industry and the support to European Policies (e.g. public procurement, innovation, interoperability). Commissioner Kroes stressed during the Openforum Europe summit that: "The reform of the European ICT standardisation framework is a simple way to bring relevant standards from the non-traditional standard-setting organisations to an equal footing with European standards when it comes to achieving interoperability". Interoperability is a key objective for the ICT domain. It should be realized by using all relevant standards, including those developed by fora or consortia if they are deemed eligible. </description>

<title>Extract from the DIGITALEUROPE priorities amendments to the WEEE recast</title>

<description>  WEEE shipments as such are already covered under the Waste Shipments Regulation and dedicated sections in the Waste Shipment Guidelines. In the recast, it would be therefore more appropriate to use the expression "shipments of used EEE" (with distinction between "for direct re-use" , "for repair with the intention of re-use", and "for refurbishment or remanufacturing with the intention of re-sale and re-use" ) instead of "shipments of WEEE". Streamlined and proportionate requirements are needed for EEE that is being sent to and from producer evaluation or test centres and repair centres as well as to refurbishment and remanufacturing centres. These products should not be classified as WEEE as long as the shipment is accompanied by a declaration that none of the material or equipment within the consignment is waste as defined in the Waste Framework Directive, and sufficient packaging is provided to protect it from damage during transportation. </description>

<title>Position on EuP Lot26 Task 1-3 reports</title>

<description>    This paper  represents DIGITALEUROPE&amp;rsquo;s position regarding the Task1-3 reports from the EuPs  preparatory study on Networked standby (DG ENER Lot 26).     In these 3 reports,  the contractors present a massive amount of information and a proposed  definition framework. DIGITALEUROPE concludes from the Task 1 report that the  products which have any kind of network standby function are for all covered by  energy efficiency related regulations such as implementing measures under the Eco-design  Directives or voluntary industry agreements. Further these products are seen to  use a wide variety of network functions related to the specific product  properties.     DIGITALEUROPE  therefore proposes to strive for incorporation of eventual regulatory  requirements in the existing product specific regulations and voluntary  industry agreements.     Further  DIGITALEUROPE proposes to revise the definitions framework of network standby  in order to more precisely understand which functions are actually present in  the network standby state: it is proposed to distinguish 3 different types of  network standby.    Apart from these  overarching proposals, DIGITALEUROPE listed a large number of detailed comments  regarding numerous parts of the draft reports. These comments are focused on  clarification and correct representation of the findings of the study.    DIGITALEUROPE  proposes to discuss the positions and comments during a meeting with the  contractors.</description>

Otherwise additional effort will be added for all involved parties and different information based on different requirements may confuse the consumers/targeted audience. </description>

<title>Position on the European Commission plans for a revision of the European Standardisation System</title>

<description>DIGITALEUROPE understands that the European Commission has the intention to present a "standardisation package" in summer which will include a revision of Directive 98/34/EC, of Council Decision 87/95/EEC and of the EP and Council Decision No 1673/2006/EC. DIGITALEUROPE supports the Commission's plans for a revision of Council Decision 87/95/EEC. The most pressing needs for such a revision are addressed by the ICT White Paper which was published by the Commission last year followed by a public consultation. DIGITALEUROPE supports the recommendations proposed in the ICT White Paper, most notably those  to introduce the list of attributes of eligibility for assessing deliverables from fora and consortia; to implement processes for direct referencing of such fora/consortia specifications in EU policies and public procurement; and to install a  permanent, multi-stakeholder, ICT standardisation policy platform as an advisory group to the Commission on ICT standardisation.   </description>

<description>DIGITALEUROPE welcomes this invitation for providing inputs and comments to support the creation of the first multi-annual Radio Spectrum Policy Programme (RSPP) to be adopted by the European Parliament and the Council. We believe that spectrum policy at EU level is not just valuable, but of strategic importance for the benefit of a sound portfolio of European Electronic Communication Services and other radio services. To this extent, we strongly support a coordinated approach in spectrum policy and implementation under the principle of technology and service neutrality where useful and applicable. Despite ongoing technological innovation, spectrum remains to be a critical element of economic service implementation. Hence, a considerate and efficient spectrum usage is a prerequisite. We trust that the first multi-annual RSPP will be able to meet these requirements last but not least by including policy outlines to satisfy all types of radio spectrum users for enabling economic growth to the benefit of the European industry and European citizens. </description>

<description>The provisions of NPRM HM-224F would affect the air transport of lithium batteries from Europe to the U.S. that currently are shipped under Section II of ICAO Packing Instructions 965 (lithium ion batteries), 966 (lithium ion batteries packed with equipment), 967 (lithium ion batteries contained in equipment), 968 (lithium metal batteries), 969 (lithium metal batteries packed with equipment, and 970 (lithium metal batteries contained in equipment). These packing instructions specify the requirements that except lithium batteries from shipment as a class 9 dangerous good.The provisions of NRPM HM-224F would significantly impact DIGITALEUROPE members who ship lithium batteries and products that are packed with or contain lithium batteries to the U.S. as the exception from shipment as a class 9 dangerous good is eliminated (other than for extremely small lithium cells and batteries packed with or contained in equipment). Therefore DIGITALEUROPE ask the European Commission to support the DIGITALEUROPE position to influence PHMSA to consider the impacts of NPRM HM-224F to its members as outlined in the document attached. </description>

<title>Letter to Malcolm Johnson on ITU databases</title>

<description>DIGITALEUROPE and its member companies remain deeply concerned by the direction of the ITU in this matter. While we are sympathetic to the challenges faced by developing countries as they seek to upgrade their current infrastructure, we are opposed to any solutions including "Resolution 76", which create barriers to trade, delay market access, increase costs, and stifle innovation. Consequently, we urge ITU to suspend the implementation of the ITU conformity and interoperability databases. We suggest that the ITU conduct a thorough analysis of the business benefits of such a program for the ITU and equipment manufacturers. The analysis should be balanced to include the costs and potential liabilities together with any measurable benefits. Particular attention should be given to illustrate the benefits of ITU recommendation compliance to resolve specific problems encountered by developing countries. The analysis should also take into account the incomprehensive nature of an ITU database given the numerous other standards bodies such as IEEE, IETF, WiMAX Forum, OIF or MEF interoperability agreements which govern relevant equipment choices for developing countries. Without such a thorough analysis, we believe that there can be no legitimate justification for creating such a database. </description>

<title>Comments on the proposal for a Directive on consumer rights</title>

<description>    DIGITALEUROPE,  the voice of the European digital technology industry, has analysed with great  interest the proposal by the European Commission for a Directive on consumer  rights and welcomes that the latter reflects many of the recommendations  DIGITALEUROPE made in its May 2007 response to the Commissions Green Paper on  the Review of the Consumer Acquis.    DIGITALEUROPE  welcomes in particular the proposed Directive&amp;rsquo;s objectives to fully harmonise consumer  rights related to cross-border transactions between traders and consumers, and  also to strike the right balance between creating a high level of consumer  protection and fostering the competitiveness of industry. A harmonised regime  of protection and a heightened level of legal certainty with regards to  consumer rights would encourage cross-border trade and strengthen the internal  market for goods &amp;ndash; all compelling arguments for adopting the Directive,  especially against the background of the current economic crisis.     In this  position paper we comment on particular aspects of the proposed Directive which  pose concerns to DIGITALEUROPE members, and where further clarification is  necessary if the Directive is to achieve its stated objectives. It should be  noted that the proposed Directive imposes obligations on traders rather than  manufacturers of goods. However, DIGITALEUROPE members &amp;ndash; in particular  manufacturers of consumer electronics &amp;ndash; would also be affected by the  Directive, not only because of the right of redress that traders have against  manufacturers, but also because manufacturers increasingly engage in direct  consumer sales and usually act as guarantors in commercial guarantees provided  to consumers.     </description>

<description>The current situation of poor levels of compliance with the R&amp;TTE Directive in the EU market has been identified by the European Commission (EC) and National Market Surveillance Authorities (MSAs) as an aspect for improvement. Digitaleurope has been involved in recent discussions and various impact assessments promoted by MSA's regarding this issue, and believe the main problems highlighted by European market surveillance authorities are twofold: - The so-called &amp;ldquo;black sheep&amp;rdquo; (i.e. Manufacturers who place products on the EU market which do not fully comply with the R&amp;TTE Directive requirements). - Poor manufacturer/importer traceability (i.e. Difficulties faced by MSAs in order to identify/ contact producers of non-compliant products).</description>

<description>DIGITALEUROPE believes that the deployment of NGA networks is beneficial as far as consumers, businesses and economic development are concerned, in particular in the context of the current economic and financial crisis. DIGITALEUROPE also considers that at this stage the deployment of NGA networks requires significant investment; hence regulatory measures applied to such networks should focus on promoting investment, innovation and infrastructure-based competition. Therefore, the proposed regulatory measures must:&amp;bull;	Be technology neutral, fair and non-discriminatory. &amp;bull;	Take into account geographic differences and market specificities. &amp;bull;	Be gradual, implemented only when the analysis of the various markets clearly demonstrates a lack of competition and applied to long lasting bottlenecks. &amp;bull;	Allow those investing in NGA networks to freely choose the most relevant technology, network topology and pricing strategy. &amp;bull;	Be symmetrical, irrespective of the nature of the investor in NGA infrastructure (cable operators, telecoms operators, utilities providers, municipalities etc). </description>

During our last meeting EC requested EICTA to provide  some concrete examples of the difficulties and costs incurred by importers of ICT products in Turkey. This updated Position Paper lists the remaining specific barriers to trade and clarifies their impacts on local and global industry. EICTA also would like to use this opportunity to inform EC of some new sets of regulations that were published on December 31st, 2008 by the UnderSecretariat of Foreign Trade, which entered into force on January 1st, 2009. <title>EICTA position on Information about restrictions for WLAN products operating on 2.4 GHz</title>

<description>2.4 GHz WLAN products are allowed to operate at power levels of up to 100 mW eirp and within the frequency range 2400 to 2483.5 MHz throughout the European Economic Area (EEA). There is only one country within the EEA where there exists a deviation from this standard rule, namely France (see details below). The current statements provided by manufacturers to inform users about the above restriction applicable in France vary largely and are from time to time challenged by regulators. EICTA seeks clarity about the statements and considers that a common approach would benefit users, regulators and industry alike. This paper sets out proposals to be discussed in TCAM and eventually endorsed by this committee. This paper focuses on 2.4 GHz WLANs but this approach could be expanded to cover restrictions on other non-harmonized bands. </description>

The European Union (EU) has established a concept of "New Approach" which allows free trade between Member States, based on Directives which contain high level "essential requirements" combined with conformity assessment modules to show compliance of the involved products, such as electrical and medical products, machinery, toys, etc. The success of this system was supported by the possibility to allow the manufacturer to issue a Supplier's Declaration of Conformity (SDoC) based on harmonized European standards. These standards are typically derived from international (IEC) safety standards, as also used in the IECEE (CB scheme) and their status of harmonization is determined by the EU Commission. </description>

<title>Comments on harmonization of chargers</title>

<description>The mobile industry has over recent years made significant progress in harmonisation of the interfaces to the mobile phones. An example is the Bluetooth standard promoted through the Bluetooth SIG and ensuring interoperability as part of the qualification scheme. In Western Europe more than 70% of mobile phones sold in 2007 incorporated Bluetooth; in 2008 more than half the mobile phones sold globally will be Bluetooth enabled. Similarly, there is growing harmonisation in data capable mobile phones supporting the USB interface for data exchange as well as charging. Standardisation activities of the charger interface are well underway including reduction in the diversity of existing charger/data interfaces. An example is the trend towards consolidation of USB connectors as micro-USB. </description>

<description>EICTA welcomes the proposal for an Implementing Measure under the Energy-using Products Directive (2005/32/EC) for External Power Supplies (EPS). We welcome the possibility to provide feedbacks and appreciate the invitation to cooperate in a constructive way with the European Commission in order to arrive at an effective and realistic Implementing Measure.The manufacturers of external power supplies and end-appliances have been investing and innovating their product over the past months. This ensures compliance with mandatory energy requirements for EPS, already, or very soon, in force in several parts of the world.Summary of the date of applications of some of these rules: California Energy Commission minimum efficiency standard: Tier I entered into force on July 1st, 2007. US Energy Independence and Security Act of 2007 will enter into force by July 1st, 2008. This Act has adopted the Tier II of the Californian mandatory rules at a Federal level, to ensure harmonised requirements throughout the US. Australia and New Zealand (defined in AS/NZS 4665): Mandatory requirements will enter into force on October 1st, 2008.</description>

We cannot meet our customers' needs if highly skilled third country nationals are required to obtain work and residence permits in each and every Member State in which our multinational customers require support or services. Delays of weeks or months are not acceptable for our clients who expect support at operations across numerous Member States. We welcome the proposal for a single work permit valid throughout the EU after a reasonable period of time. </description>

Increased transparency and structures for an on-going dialogue with industry and other stakeholders are also essential to enable the smooth operation of a Directive affecting fast-evolving technological sectors. Last but not least, we encourage the EU institutions to consider how the process for adopting or repealing exemptions could be streamlined and made more transparent. </description>

<title>Reflections/ Comments on eGovernment research in FP7 </title>

<description>In Manchester 2005 and Lisbon 2007, EICTA presented its own eGovernment Industry Declaration to complement the Member States' statements. This declaration made commitments to contribute to the development of the eGovernment agenda. EICTA agrees with the Ministers that the eGovernment objectives outlined in the Manchester Ministerial Declaration in 2005 and confirmed in the eGovernment Action Plan by the Council in June 2006 are still valid. Both the declaration and the plan make clear that research, including technology socio-economic areas, is vital to achieve the goals for eGovernment. EICTA welcomes the fact that the Ministerial Declaration from 2007 continues to invite the European Commission to define and support research activities in eGovernment. EICTA believes that the policy context for eGovernment research in the Seventh Framework Programme (FP7) has been thoroughly established by the 2006 eGovernment Action Plan and the two Ministerial Declarations on European eGovernment agreed in November 2005 and September 2007. These provide the basis for a holistic approach to eGovernment through co-operation between the European Commission and Member States that links policy, deployment, and promotion of good practice, measurement and eGovernment research.</description>

However, we would like to note that consumer protection should be set at a reasonable level.
